TERMS AND CONDITIONS
1. These terms and conditions of entry, which include information on how to participate and the prize details, apply to the “One Millionth Holden Scramble Participant Promotion”. Entry into the promotion is deemed acceptance of these terms and conditions.
PROMOTER
2. The promoter is Professional Golfers Association of Australia Limited, 600 Thompsons Rd, SANDHURST VIC 3977, (03) 8320 1911, ABN 46127641829

PROMOTION PERIOD
3. The “One Millionth Holden Scramble Participant Promotion” will open 10.00am AEST on Tuesday 1st of March 2016 and close, if not already announced, on Sunday 2nd October 2016.
4. Please note: this promotion will run throughout the 2016 Holden Scramble Season and may be announced prior to the closing date, if the one millionth Holden Scramble participant is reached.

ELIGIBLE ENTRANTS

5. Entry into the promotion is only open to Australian residents who:
a) Register to play in a Holden Scramble Local event between March 1 and October 2, 2016.
b) Entrants must register in a Local event via the Holden Scramble Website (thescramble.wpengine.com) or by filling out an official Holden Scramble Registration form.
c) Selected by the PGA of Australia National Event’s Team who deem the participant as the One Millionth Holden Scramble Player.

Entry excludes:
a) Management, employees, directors and contractors of the Promoter, its related bodies corporate, and other agencies, firms or companies associated with the Promotion (including suppliers of prizes);
b) Persons who have used or attempted to use more than one name in order to qualify to win a promotion run by or on behalf of the Promoter (except in the case of a legal name change) and
c) Persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter.

HOW TO ENTER

6. Eligible Entrants will be ranked in order of entry for each local event they are registered in – Online entries will be displayed in order of receipt. Holden Scramble Coordinators are asked to file paper entries in date of receipt.
7. The promoter reserves the right at any time to verify the validity of any entrant and to disqualify any entrant who submits an entry not in accordance with these terms and conditions.

PRIZES

8. Prize pack to be awarded to the lucky winner and his/her three Holden Scramble team members and include:

a) Prize Pack Includes:
i. Return Economy airfares from the winner’s nearest capital city to Sydney
ii. Four return economy class airfares flying Delta Air Lines to the USA
iii. Four night’s accommodation for four people (4 star; twin-share).
iv. Inbound & Outbound transfers associated with Delta Air Lines International flight.
v. Entry for four people into the 2017 PGA Tour Championship (Dates TBC – September 2017)

The trip does not (except as expressly stated) include:
i. any overnight accommodation while travelling to Sydney
ii. any other travel or accommodation, other than stated in the prize draw
iii. any food and beverages consumed, other than stated in the prize draw
iv. any incidental hotel charges (such as mini-bar charges, telephone calls, in house movies, food and beverages);
v. any insurance (such as travel or health cover)
vi. any vaccinations or other medical or health related services;
vii. any other ancillary costs which may be incurred by those travelling

All aspects of the Trip (including travel and accommodation) are for four people.

Once booked, changes to the traveller’s details, travel, flights or accommodation arrangements cannot be made.

The trips cannot be exchanged for other travel, flights or accommodation at other destinations.

Any part of the Trip that is not taken for any reason is forfeited.

The Trip winner must hold a valid credit card and present on check in at accommodation, to cover any incidental hotel charges.

Participation in the Trip is subject to such other terms and conditions as may be imposed by those involved in providing other goods or services included in the Trip (Third Party Terms.

TOTAL VALUE OF PRIZES

9. The total value of prizes available for distribution in the promotion is up to $22,000

PRIZE DRAW

10. The one millionth participant will be decided by the PGA of Australia, who they deem to be the One Millionth Holden Scramble Player.
11. The prize draw will be drawn between 1st March – 2th October 2016
12. The PGA Events Division will monitor entries beginning March 1st 2016 and scrutinize when the One Millionth Player will be. If that one millionth participant falls on day where multiple events are being held, those events will go into a random draw to select the event that the one millionth participant will be chosen.

NOTIFICATION OF WINNER

13. The one millionth participant will be;
a) Notified immediately at their local event
b) Published on the HS website (thescramble.wpengine.com) on 10/10/2016 or once winner is announced.

UNCLAIMED PRIZE

14. If an Eligible Entrant does not claim their Prize by 10.00am 31/01/2017, the next entered participant from the local event will be awarded the prize, subject to any directions from State and Territory Gaming Departments.

NOTIFICATION OF SUBSTITUTE WINNER

15. The substitute winner, if any, will be:
a) Notified by phone and email; and
b) Will be posted on the Holden Scramble Website (thescramble.wpengine.com) by the 03/02/2017

16. Prize information will be delivered to the residential address as advised by the respective winner.

17. Acceptance of the prize is subject to terms and conditions imposed by those involved in providing goods and/or services as part of or in connection with the prize.

18. If more than one person attempts to claim a Prize, the Promoter has sole and absolute discretion to determine which of those persons the winning entrant is.

GENERAL

19. Prize is not transferable, exchangeable or redeemable for cash. Prize must be taken as offered and may not be varied.

20. The value of the prize is correct as of 15/01/2016. The Promoter accepts no responsibility for any variation in the value of the prize from this time.

21. If the Promoter is unable to provide a winner(s) with a nominated prize, the Promoter reserves the right to supply an alternative prize of similar monetary value to the nominated prize, subject to any directions given by State and/or Territory Gaming Departments.

22. The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries. The Promoter does not warrant that the entry mechanism will be available, or the events will run as scheduled, at all times during the Promotion Period.

23. If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to States and Territories regulations, including cancelling, terminating, modifying or suspending the promotion.

24. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism or Prize Draw in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.

25. Incomplete, illegible, indecipherable or incorrect entries are not eligible to win.

26. The:
a) Promoter, the Promoter’s related entities and all agencies associated with the Promotion; and
b) the employees, agents, directors and contractors, of all entities referred to in paragraph (a),

shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance/participation in the Prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).

27. The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of a prize.

28. The Prize Winner must, at the Promoter’s request, participate in any Promotion activity (such as publicity and photography) relating to the winning of a prize, free of charge, and they consent to the Promoter using their name and image in any future promotional material.

CAUTION: Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the promoter reserves the right to seek damages to the fullest extent permitted by law.

PERSONAL INFORMATION

29. All entries become the sole property of the Promoter.

30. All information Entrants provide (Personal Information) will be used by the Promoter for the purpose of conducting this Promotion and may be entered into a database and the Promoter, the Promoter’s related entities, agencies engaged by the Promoter, or any other third party nominated by the Promoter, for the Promoter’s current and future promotional and marketing purposes without further reference or compensation to them.

31. The Promoter may disclose Entrants’ Personal Information to its contractors and agents to
assist in conducting this Promotion and as required, to Australian regulatory authorities.

32. Entrants can request access to update or correct their Personal Information held by the Promoter and may request that they not receive further Promotional or marketing communications from the Promoter by contacting the Promoter at the address above. Should an Entrant’s contact details change during the Promotion Period, it is the Entrant’s responsibility to notify the Promoter.

33. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.
